สิทธิ ของผู้บริโภคเมื่อถูกโต้แย้งสิทธิ
ผู้บริโภคที่ได้รับความเดือดร้อนเสียหายจากการใช้สินค้าหรือบริการจากผู้ประกอบการ ผู้บริโภคสามารถใช้สิทธิดำเนินการกับผู้ประกอบการได้ 2 กรณี คือ
1. ร้องทุกข์ต่อสำนัก งานคณะกรรมการคุ้มครองผู้บริโภค (ส.ค.บ.)
2. ยื่นฟ้องคดีต่อศาล เอง
กรณีร้องทุกข์
กรณีร้องทุกข์ต่อสำนักงานคณะกรรมการคุ้มครอง ผู้บริโภค (ส.ค.บ.) ผู้บริโภคสามารถเข้าร้องทุกข์ต่อเจ้าหน้าที่ สำนักงานคณะกรรมการคุ้มครองผู้บริโภค ได้เองโดยตรง เมื่อเจ้าหน้าที่รับเรื่องราวที่ร้องทุกข์ไว้แล้ว เจ้าหน้าที่จะดำเนินการเรียกได้ผู้ประกอบการให้มาชี้แจงข้อเท็จจริง เพื่อมีคำสั่งต่อไป แต่คณะกรรมการคุ้มครองผู้ บริโภคไม่มีอำนาจสั่งให้ผู้ประกอบการชดใช้ค่าเสียหายให้แก่ผู้บริโภคได้ เว้นแต่ในกรณีที่คณะกรรมการเห็นสมควรเข้าดำเนินคดีเกี่ยวกับการละเมิดสิทธิ ของผู้บริโภคหรือเมื่อได้รับคำร้องทุกข์จากผู้บริโภคที่ถูกละเมิดสิทธิ หากคณะกรรมการเห็นว่าการดำเนินคดีนั้นจะเป็นประโยชน์แก่ผู้บริโภคส่วนรวม คณะกรรมการมีอำนาจแต่งตั้งพนักงานอัยการโดยความเห็นชอบ ของอัยการสูงสุด หรือเจ้าหน้าที่คุ้มครองผู้บริโภค เพื่อให้มีอำนาจดำเนินคดีแพ่งหรือคดีอาญาแก่ผู้กระทำการละเมิดสิทธิของผู้ บริโภคในศาล โดยในการดำเนินคดีในศาลนั้น เจ้าหน้าที่คุ้มครองผู้บริโภคมีอำนาจฟ้องเรียกทรัพย์สินหรือค่าเสียหายให้ แก่ผู้บริโภคได้ โดยได้รับรับการยกเว้นค่าฤชาธรรมเนียมศาลทั้งหมด ซึ่งขั้นตอนในการดำเนินการอาจยุ่งยากหลายขั้นตอนและใช้เวลานานไม่สะดวกแก่ ผู้บริโภคเท่าที่ควร รวมทั้งอาจไม่ตรงกับความประสงค์ของผู้บริโภคเองที่ต้องการได้รับการเยียว ยาความเสียหายที่เกิดขึ้นโดยเร็ว
กรณีผู้บริโภคฟ้องคดีเอง
ผู้บริโภคที่ได้รับความเดือดร้อนเสียหายจาก การใช้สินค้าหรือบริการจากผู้ประกอบการ สามารถฟ้อง คดีเองได้ โดยในเบื้องต้นผู้บริโภคสามารถยื่นฟ้องผู้ประกอบการต่อศาลที่เป็นภูมิลำเนา ของผู้บริโภคเองหรือจะฟ้องต่อศาลที่ผู้ประกอบการมีภูมิลำเนาอยู่ก็ได้แล้ว แต่ความสะดวกของผู้บริโภคเอง ซึ่งในการยื่นคำฟ้อง นั้น ผู้บริโภคสามารถฟ้องคดีด้วยวาจาหรือยื่นคำฟ้องเป็นหนังสือก็ได้ กรณีที่ฟ้องด้วยวาจา เจ้าพนักงานคดีจะจัดให้มีการบันทึกรายละเอียดแห่งคำฟ้องและให้ผู้บริโภคซึ่ง เป็นโจทก์ลงลายมือชื่อไว้เป็นสำคัญ ส่วนการยื่นคำฟ้องเป็นหนังสือนั้น หากผู้บริโภคไม่สามารถร่างคำฟ้องได้เอง อาจจะเป็นเพราะไม่มีความรู้ด้านกฎหมาย ผู้บริโภคสามารถขอให้เจ้าพนักงานคดีที่ประจำศาลนั้นช่วยร่างคำฟ้องตลอดจนจัด ทำบัญชีระบุพยานให้ได้ โดยเล่าข้อเท็จจริงและความเสียหายที่ได้รับจากการใช้สินค้าหรือบริการให้ เจ้าพนักงานคดีฟัง พร้อมทั้งยื่นเอกสารประกอบ(ถ้าหากมี)เพื่อให้เจ้าพนักงานคดีใช้เป็นข้อมูล ประกอบการร่างคำฟ้องและจัดทำบัญชีระบุพยาน ซึ่งหากคำฟ้องขาดตกบกพร่องในสาระสำคัญบางประการ ศาลมีอำนาจสั่งให้ผู้บริโภคซึ่งเป็นโจทก์แก้ไขคำฟ้องได้ กรณีนี้จะแตกต่างจากคำฟ้องคดีสามัญทั่วไปที่ศาลไม่มีอำนาจสั่งให้โจทก์แก้ไข คำฟ้องได้ นอกจากนี้ในการยื่นฟ้องดังกล่าวนั้น ผู้บริโภคจะได้รับยกเว้นค่าฤชาธรรมเนียมศาลทั้งปวงเช่นเดียวกับคณะกรรมการ ผู้บริโภคฟ้องคดีแทน
ภายหลังจากยื่นฟ้องแล้ว ศาล จะกำหนดนัดพิจารณาภายใน 1 เดือน กระบวนพิจารณาคดีผู้บริโภคนั้นมีเจตนารมณ์เพื่อให้เกิด ความสะดวกรวดเร็วและเป็นธรรมแก่ผู้บริโภค โดยก่อน เริ่มพิจารณาศาลจะให้คู่ความไกล่เกลี่ยกันก่อนหากไกล่เกลี่ยกันแล้วสามารถ ตกลงกันได้ คดีก็เสร็จสิ้นการพิจารณาในนัดพิจารณาเพียงนัดเดียว
แต่ หากคดีไม่สามารถตกลงกันได้และจำเลยที่เป็นผู้ประกอบการยื่นคำให้การต่อสู้ คดี ศาลจะสอบถามคู่ความเกี่ยวกับพยานที่จะนำพยานเข้าสืบทั้งพยานบุคคลและพยาน เอกสาร และศาลจะกำหนดวันนัดสืบพยานโจทก์และจำเลยโดยเร็วเช่นกัน ซึ่งจะเร็วหรือช้าเพียงใดก็แล้วแต่ว่าศาลนั้นมีคดีค้างพิจารณาอยู่มากน้อย เพียงใด โดยในชั้นพิจารณาสืบพยานผู้บริโภคจำเป็น ต้องมีทนายความคอยช่วยเหลือเพื่อทำหน้าที่ว่าความให้ เพราะแม้ตาม พ.ร.บ. วิธีพิจารณาคดีผู้บริโภค พ.ศ.2551 กฎหมายจะกำหนดให้ศาลมีอำนาจถามพยานเองได้ก็ตาม แต่หากผู้บริโภคซึ่งเป็นโจทก์ยื่นฟ้องคดีเองแล้วไม่มีทนายความคอยช่วยเหลือ ทำหน้าที่ว่าความ โดยการนำพยานเข้าสืบ ถามค้านพยานจำเลย แล้วย่อมทำให้การดำเนินกระบวนพิจารณาในชั้นสืบพยานโจทก์หรือถามค้านพยาน จำเลย เสียเปรียบคู่ความอีกฝ่ายหนึ่งที่มีทนายความคอยช่วยเหลือว่าความแก้ต่างให้ ซึ่งอาจส่งผลกระทบแก่ท่านจนถึงขั้นแพ้คดีได้ นอกจากนี้ศาลเองก็ไม่อาจแต่งตั้งทนายความให้แก่โจทก์ที่เป็นผู้บริโภคได้ เหมือนเช่นคดีอาญา
