ผมได้ฟังข่าวอยู่เป็นประจำเกี่ยวกับเรื่องพระภิกษุสงฆ์เสพเมถุนกับสีกา ล่าสุดที่ได้ยินครับมีพระภิกษุถูกยิงมรณภาพ แรกเริ่มฟังก็คิดเลยว่าใครกันนะใจบาปฆ่าได้แม้กระทั่งพระสงฆ์ชั่งบาปจริงๆ แต่พอติดตามข่าว คิดวิเคราะห์เหตุการณ์ก็พอจะเริ่มจับใจความโดยย่อได้ว่า (ในส่วนนี้ผมขอบอกเป็นชื่อย่อแล้วกันครับเนื่องจากศาลยังมิได้มีการตัดสิน) เรื่องคือ นาย ป. ผู้กระทำความผิดฐานฆ่าคนตายโดยเจตนา ได้อยู่กินกับ น.ส. ล. มานานกว่า 20 ปี จนมีบุตรด้วยกัน 2 มีอาชีพเลี้ยงกุ้ง เลี้ยงปลา ที่ผ่านมานั้นในช่วงเวลากลางคืน จะไปนอนเฝ้าอยู่ที่บ่อเลี้ยงกุ้ง บ่อเลี้ยงปลา ไม่เคยทราบมาก่อนว่าภรรยาของตนแอบมีชู้ จนมาระยะหลังได้เริ่มระแคะระคายจากข่าวจากปากของชาวบ้านมาบ้างว่า มีพระเป็นหมอทำเสน่ห์ ทำไสยศาสตร์ ได้แอบเข้ามาพบกับภรรยาของของ นาย ป. ในทางชู้สาวอยู่บ่อยครั้ง เวลากลางคืนจะมารับตัว น.ส.ล. ออกไปนอกบ้าน เมื่อทราบเรื่องใหม่ๆ ก็บอกให้เลิกทำพฤติกรรมนั้นเสีย แต่ก็ยังไม่ยอมเลิกรา จนในวันเกิดเหตุ ช่วงหัวค่ำขณะที่กำลังทำงานเฝ้าอยู่ในบ่อเลี้ยงกุ้ง นาย ป. รู้สึกหิวข้าวจึงได้เดินกลับจากบ่อกุ้งเข้ามายังบ้านพัก พร้อมกับได้ถืออาวุธปืนลูกซอง ที่ใช้ถือติดตัวในการเฝ้าทรัพย์สินอยู่เป็นประจำมาด้วย เนื่องจากในพื้นที่มีโจรขโมยชุกชุม และไม่ได้ตั้งใจจะมาก่อเหตุ แต่เมื่อมาถึงบ้านก็ได้พบกับพระ ม. ได้ขับรถมาถึงที่เกิดเหตุพอดี นาย ป. จึงได้ร้องตะโกนถามพระ ม. ว่า "จะไปไหน" โดยที่พระ ม. กลับพูดจาแบบนักเลงใส่ตนว่า "กูจะมาหาเมีย" นาย ป. ถามว่าจะมารับเมียกูไปไหน พระ ม. ตอบว่า "เมียมึง ก็เหมือนเมียกู" จึงทำให้รู้สึกเจ็บปวด และเกิดบันดาลโทสะอย่างมาก จึงได้ใช้อาวุธปืนที่ถือติดมือมายิงเข้าใส่ 1 นัด จากนั้นจึงได้หลบหนีออกจากบ้านไปและกลับมามอบตัวกลับตำรวจ
จากข่าวดังกล่าวผมก็มานั่งคิดแบบงงๆว่า อ้าว! สรุปว่าใครเป็นคนที่ผิดจริงๆกันแน่ เรามาดูกันเป็นรายบุคคลและรายองค์กันเลยครับ
นาย ป. เห็นได้ว่าเป็นสามีของ น.ส. ล. แม้จะไม่ชอบด้วยกฎหมายก็ตามแต่เมื่ออยู่กินฉันสามีภรรยาจนมีบุตรด้วยกันถึงสองคนแล้ว นาย ป. ย่อมเป็นสามีของนางสาว ล. โดยพฤตินัย มีสิทธิที่จะปกป้องสิทธิของตนในฐานะสามี เมื่อมีบุคคลอื่นมายุ่งเกี่ยวหรือข้องแวะกับเมียตัวเอง นาย ป. ก็สามารถปกป้องสิทธิของตนเองได้ เมื่อพระ ม. เข้ามายุ่งเกี่ยวกับ นางสาว ล. เมียของตน ในลักษณะชู้สาวและยังพูดจาในลักษณะอันเป็นการเหยียดหยามและข่มเหงทางจิตใจกันอีก จึงทำให้นาย ป. เกิดบันดานโทสะใช้ปืนลูกซองที่พกติดตัวยิงพระ ม. หนึ่งนัดเสียชีวิต ซึ่งตามประมวลกฎหมายอาญามาตรา 72 บัญญัติว่า “ผู้ใดบันดาลโทสะโดยถูกข่มเหงอย่างร้ายแรงด้วยเหตุอันไม่เป็นธรรม จึงกระทำความผิดต่อผู้ข่มเหงในขณะนั้น ศาลจะลงโทษผู้นั้นน้อยกว่าที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้“ การที่นาย ป. ใช่ปืนยิงนายพระ ม. ก็เนื่องจาก พระ ม. พูดจาแบบนักเลงใส่ตนว่า "กูจะมาหาเมีย" นาย ป. ถามว่าจะมารับเมียกูไปไหน พระ ม. ตอบว่า "เมียมึง ก็เหมือนเมียกู" ถือว่าเป็นการข่มเหงจิตใจอย่างร้ายแรงด้วยเหตุอันไม่เป็นธรรม แม้ว่านาย ป. กัน นางสาว ล. จะไม่ได้เป็นภรรยาโดยชอบด้วยกฎหมายแต่ก็อยู่กินกันมากว่า 20 ปี จนมีบุตรด้วยกันถึง 2 คน ย่อมมีความรักใคร่และห่วงแหน การที่นาย ป. ใช่ปืนลูกซองที่ปกติดตัวเพื่อป้องกันทรัพย์อยู่เป็นประจำยิง พระ ม. ไปหนึ่งนัดในขณะนั้น จึงเป็นการกระทำความผิดต่อผู้ข่มเหงในขณะนั้น การกระทำของนาย ป. จึงเป็นการกระทำโดยบันดาลโทสะเพราะถูกข่มเหงทางจิตใจอย่างร้ายแรงด้วยเหตุอันไม่เป็นธรรมศาลสามารถใช้ดุลพินิจจะลงโทษนาย ป.สำหรับความผิดฐานฆ่าคนตายเพียงใดก็ได้ อ้างอิงตามคำพิพากษาฎีกาที่ 249/2515 ในส่วนตัวของผมไม่ลงโทษน่าจะดีกว่า

พระ ม. อันดับแรกเลยคือผิดศีลธรรมอย่างร้ายแรงเป็นถึงพระสงฆ์ มาทำพฤติกรรมในทางไม่สมควร เป็นการทำลายศาสนาอย่างร้ายแรง ในส่วนที่สอง การที่พระเสพเมถุนเป็นการกระทำผิดวินัยสงฆ์มีโทษทางวินัยต้อง ปราชิก และต้องสึกจากการเป็นพระสงฆ์ ที่นี้มาเรามาดูเกี่ยวกับโทษทางอาญากันบ้าง ตามประมวลกฎหมายอาญา มาตรา 206 บัญญัติว่า “ผู้ใดกระทำด้วยประการใดๆ แก่วัตถุหรือสถานอันเป็นที่เคารพในทางศาสนาของหมู่ชนใด อันเป็นการเหยียดหยามศาสนานั้น ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงเจ็ดปี หรือปรับตั้งแต่สองพันบาทถึงหนึ่งหมื่นสี่พันบาท หรือทั้งจำทั้งปรับ” จากบทบัญญัตินี้ผมขอกล่าวรวมไปถึงพระสงฆ์ที่เสพเมถุนกับสีกาหรือชายหรือกับสัตว์ไปคราวเดียวกันเลย ว่าพระสงฆ์เหล่านี้จะมีความผิดทางอาญาอย่างไร จากกฎหมายมาตรา 206 เป็นการเอาโทษกับบุคคลที่กระทำการอันมิสมควรกับหรือสถานที่อันเป็นที่เคารพในทางศาสนาของผู้คนทั่วไป การกระทำด้วยประการใดๆ หมายความว่าการกระทำอันมิสมควรไปในทางเหยียดหยามศาสนา เช่นการกระทำของพระสงฆ์ที่เสพเมถุนผมถือว่าเป็นการกระทำที่ไม่สมควรและเป็นการเหยียดหยามศาสนาแล้ว แต่เราต้องมาดูองค์ประกอบของความผิด มาตรา 206 ว่าการกระทำอันมิสมควรนั้นต้องเป็นการกระทำต่อวัตถุหรือสถานที่อันสถานที่อันเป็นที่เคารพในทางศาสนาของหมู่บุคคล แต่ในกรณีที่พระสงฆ์เสพเมถุนนั้นแม้จะเป็นการกระทำอันไม่สมควรต่อศาสนาแต่ไม่ได้กระทำต่อวัตถุหรือสถานที่อันเป็นที่เคารพ ทำให้ไม่ครบองค์ประกอบความผิดของกฎหมาย จึงไม่สามารถเอาผิดทางอาญากับพระที่เสพเมถุนได้แม้ว่าจะเป็นการทำลายศาสนาอย่างร้ายแรงก็ตาม แต่ถ้าหากเช่นกรณีพระสงฆ์นั้นเสพเมถุนกันในโบสถ์หรือในวิหารก็น่าจะเข้าองค์ประกอบความผิดของกฎหมาย แม้ว่าจะมิได้กระทำกับวัตถุหรือสถานที่โดยตรงแต่หากตีเจตนารมณ์ของกฎหมายน่าจะหมายความรวมถึงการกระทำภายในหรือบริเวณสถานที่อันเป็นที่เคารพด้วย น่าจะเอาผิดทางกฎหมายได้บ้าง ในส่วนกฎหมายยังไม่มีการบัญญัติไว้โดยตรงว่าการเสพเมถุนของพระสงฆ์เป็นความผิดอาญา จึงมีโทษทางวินัยเท่านั้น
ผมได้ศึกษาข้อกฎหมายที่เกี่ยวข้องแล้วก็ไม่มีกฎหมายใดที่จะเอาผิดกับพระสงฆ์ประเภทนี้ได้บ้าง จนมาพบกับข้อความที่กล่าวในหนังสือพิมพ์ฉบับหนึ่งของ น.พ.จักธรรม ว่าได้เคยมีการเสนอความเห็นเกี่ยวกับการเอาผิดทางอาญากับพระสงฆ์และคู่นอนพระสงฆ์ เนื่องจากเป็นการทำลายศาสนา สร้างความเสื่อมเสียให้แก่คณะสงฆ์แล้วยังสร้างความเสื่อมเสียให้แก่พุทธศาสนาด้วย โดยก่อนหน้านี้สำนักงานพระพุทธศาสนาได้ปรึกษากับทั้งภาครัฐและเอกชนเสนอให้คณะปฏิรูปการปกครองในระบอบประชาธิปไตย อันมีพระมหากษัตริย์ทรงเป็นประมุข(คปค.) โดยมีการเสนอให้มีบทลงโทษทางอาญากับพระที่เสพเมถุนและคู่นอน แต่ตอนนี้ไม่ทราบว่าเรื่องไปถึงไหนแล้ว ผมก็ขอให้มีร่างกฎหมายเกี่ยวกับการเอาผิดทางอาญากับพระสงฆ์และคู่นอนพระสงฆ์เข้าสู่การพิจารณาของสภานิติบัญญัติจริงเถอะครับ
