ความหมายประเภทของเงินได้พึงประเมินและการรับรู้รายได้ของบุคคลธรรมดา
ความหมายของเงินได้พึงประเมินตามประมวลรัษฎากร คือ เงินได้ที่บุคคลธรรมดา (ม.56-ม.57เบญจ) ได้รับนั้นไม่ว่าจะเป็นเงินที่ได้มาจากแหล่งใด เงินได้ที่กล่าวมานั้นในกรอบของกฎหมายภาษีถือเป็นเงินได้พึงประเมิน เป็นเงินได้ที่ผู้เสียภาษีมีหน้าที่แสดงเงินได้ของตน และยื่นชำระภาษีให้ภูกต้องครบถ้วนตามที่กฎหมายกำหนด แต่ถ้ามีการคำนวณภาษีไม่ถูกต้อง หรือมีเหตุที่น่าสงสัยในเรื่องเงินภาษีที่ยื่นแบบคำนวณไว้ กฎหมายให้เจ้าหน้าที่มีสิทธิตรวจสอบข้อเท็จจริงจากผู้เสียภาษีได้ ความหมายของเงินได้พึงประเมินตามกฎหมายนั้นสามารถแยกได้ดังนี้
เงินได้พึงประเมินตามมาตรา 39 แห่งประมวลรัษฎากรได้ให้ความหมายไว้ว่า
1.เงิน มีความหมายเป็นได้ทั้งเงินไทย หรือเงินตราต่างประเทศ
2.ทรัพย์สินซึ่งอาจคิดคำนวณได้เป็นเงิน หมายถึงทรัพย์สินที่มีรูปร่างและไม่มีรูปร่าง ที่ได้รับ (มาแล้วจริงๆ ในปีภาษีนั้นๆ)และสามารถคิดคำนวณได้เป็นเงิน เช่น รถยนต์ บ้าน นาฬิกา สร้อยคอ เป็นต้น
3.ประโยชน์ซึ่งอาจคิดคำนวณได้เป็นเงิน หมายถึงประโยชน์ที่ได้รับ (มาแล้วจริงๆ ในปีภาษีนั้นๆ)มาที่ไม่ใช่ตัวเงิน ไม่ใช่ทรัพย์สิน แต่ประโยชน์ที่ว่านี้สามารถคิดคำนวณเป็นเงินได้ เช่น การที่นายจ้างให้การอุดหนุนแก่ลูกจ้างในรูปของที่อยู่อาศัย อาหารกลางวัล เป็นต้น
4.เงินค่าภาษีอากรที่ผู้จ่ายเงินหรือผู้อื่นออกแทนให้ เงินค่าภาษีถือว่าเป็นเงินได้ คือ เงินนค่าภาษีที่ออกให้ถอดใดถือเป็นเงินได้ของถอดนั้น เงินค่าภาษีที่ออกให้เงินได้ประเภทใดถือเป็นเงินได้ประเภทนั้น เงินค่าภาษีที่ออกให้สำหรับเงินได้ของปีใดถือเป็นเงินได้ของปีภาษีนั้น
5.เครดิตภาษีตามที่กฎหมายกำหนด คือเงินปันผลนั้นครั้งหนึ่งก็คือกำไรสุทธิ ซึ่งได้เสียภาษีเงินได้นิติบุคคลมาแล้ว เมื่อมีการจ่ายเงินปันผลมาให้บุคคลธรรมดาอีก ทำให้ต้องเสียภาษีในเงินปันผลนี้อีกครั้งหนึ่ง จะเห็นได้ว่าเป็นการเก็บภาษีซ้ำซ้อนในเงินปันผลดังกล่าว ดังนั้นเพื่อเป็นการบันเทาภาระภาษีจึงมีการให้เครดิตภาษีในเงินปันผล ตามที่กฎหมายกำหนดในมาตรา 47 ทวิ
ประเภทของเงินได้พึงประเมิน
ประมวลรัษฎากรได้แบ่งเงินได้พึงประเมินออกเป็น 8 ประเภท คือ
มาตรา 40(1) เงินได้จากการจ้างแรงงงานและประโยชน์อย่างอื่นที่ได้รับจากการจ้างแรงงาน
มาตรา 40(2) เงินได้จากการจ้างทำของและประโยชน์อย่างอื่นที่ได้รับจากการจ้างทำของ
มาตรา 40(3) เงินได้จากค่าสิทธิ
มาตรา 40(4) เงินได้จากดอกเบี้ย เงินปันผล เงินส่วนแบ่งจากกำไร
มาตรา 40(5) เงินได้จากการให้เช่าทรัพย์สิน
มาตรา 40(6) เงินได้จากวิชาชีพอิสระ
มาตรา 40(7) เงินได้จากการรับเหมา
มาตรา 40(8) เงินได้จากการธุรกิจการพาณิชย์
จากการที่กล่าวมาแบ่งเงินได้พึงประเมินออกเป็น 2 ประเภทดังนี้
เงินได้พึงประเมินประเภท Paassive Income ได้แก่ เงินได้ตามมาตรา 40(3) ,40(4),40(5) คือ เงินได้ที่ผู้มีเงินได้มิได้มาส่วนร่วมใวนการประกอบการที่ทำให้เกิดเงินได้
เงินได้พึงประเมินประเภท Active Income ได้แก่เงินได้ตามมาตรา 40(1),40(2),40(6),40(7) ,40(8) คือเงินได้ที่ผู้มีเงินได้มีส่วนร่วมใสนการประกอบการที่ทำให้เกิดเงินได้
เกณฑ์การรับรู้รายได้ของบุคคลธรรมดา
การเสียภาษีเงินได้ของบุคคลธรรมดาจะใช้เกณฑ์เงินสดคือ เงินได้พึงประเมินที่ได้รับในปีภาษีใดย่อมเป็นเงินได้ที่ต้องเสียภาษีในปีภาษีนั้น(เว้นแต่มีกฎหมายยกเว้นเงินได้ที่ได้รับ ให้ไม่ต้องเสียภาษี เช่น มาตรา 42,กฎกระทรวง,พระราชกฤษฏีกา เป็นต้น ) คำว่าได้รับคือ ได้รับมาแล้วจริงๆ ไม่ใช่สิทธิคิดว่าได้รับเช่น
บริษัท ข ได้จ่ายเงินให้นาย ก ในกรณีที่ว่าจ้างนาย ก เป็นเงินจำนวนทั้งสิ้น 20,000,000 ในการชำระเงินนั้น ในสัญญาว่าจ้างได้มาการตกลงแบ่งชำระกันเป็น 2 งวด คือ งวดแรกในปีพ.ศ. 2552 เป็นเงินจำนวน 10,000,000 และงวดที่ 2 พ.ศ. 2553 เป็นเงิน 10,000,000 ในการเสียภาษีปี พ.ศ. 2552 นาย ก ต้องเสียภาษีในเงินจำนวน10,000,000 เท่านั้นเพราะเป็นเงินที่ได้รับมาแล้วกับเงินได้อื่นถ้ามี มิได้เสียภาษีในจำนวนเงิน 20,000,000 เต็มจำนวน และส่วนที่เหลือแม้ว่าจะมีการกำหนดว่าจะจ่ายเงินกันในปีพ.ศ. 2553 แต่ถ้ามิได้มีการจ่ายกันจริงแต่จ่ายในปีอื่นเช่นจ่ายในปีพ.ศ. 2553 ย่อมเป็นเงินได้ที่ต้องเสียภาษีปี พ.ศ. 2553
ปล.ความหมายของเงินได้พึงประเมินเป็นสิ่งที่ทำให้ทราบว่ารัฐจัดเก็บเงินได้อะไรจากผู้เสียภาษี และเงินได้ที่จัดเก็บนั้นครอบคลุมถึงอะไรบ้างเพราะอาจมีบางคนเข้าใจว่าเงินได้ก็คือเงินตราที่ใช้ทั่วไป ซึ่งเป็นความหมายที่ 1 เท่านั้น การที่รัฐขยายฐานการจัดเก็บภาษีออกไปเช่นนี้เพราะต้องการรายได้ไปเข้าคลังของรัฐเพื่อใช้ในการพัฒนาประเทศใสนด้านต่างๆ ดังนั้น ทุกคนควรเสียภาษีเพื่อประเทศชาติของเรานะค๊ะ
